TERMS OF SERVICE AND PRIVACY POLICY (GDPR COMPLIANT)

Welcome to AI Music Analyzer (hereinafter: "Service Provider"). Please read these Terms of Service carefully before using our platform. By accessing or using our services, you agree to be bound by these terms.

1. DESCRIPTION OF SERVICE AND TECHNICAL SPECIFICATIONS

The Service Provider offers a cloud-based, Artificial Intelligence-driven software tool designed for the technical and statistical analysis of audio files.

• Complex Analysis: The software extracts and quantifies a wide range of musical parameters, including but not limited to: Tempo (BPM), Key and Chord Progressions, Spectral Balance, Dynamic Range (LUFS), Emotional Tone, Instrumental Density, and Genre Characteristics.
• Hit Potential Assessment: Based on the extracted data, the algorithm performs comparative statistical calculations to provide a percentage-based estimate ("Hit Potential") regarding the track's market receptivity.
• Use of Results: All reports and data generated during the analysis are the property of the User, who is entitled to use them for promotional, professional, or personal purposes.

2. TOKEN SYSTEM, PRICING, AND VALIDITY

Access to the platform's analysis features is managed through an internal credit system called "Tokens."

Token Units:

• Simple Analysis: Consumes 1 Token per track (includes basic parameters and hit potential percentage).
• Detailed Analysis: Consumes 3 Tokens per track (includes deep-dive technical parameters and a comprehensive report).

Validity and Expiration:

Tokens are purchased in packages. The availability period may vary depending on the chosen package, but all tokens are valid for a maximum of one (1) year (365 days) from the date of purchase. Expired tokens are automatically removed from the account and are non-refundable.

Refund Policy:

Tokens are digital content. Once a purchase is made, refunds are not provided unless the service was demonstrably unavailable for a period exceeding 72 hours following the purchase.

3. MUSIC SECURITY AND COPYRIGHT (NO-STORAGE POLICY)

The Service Provider prioritizes the protection of intellectual property and confidentiality.

• Retention of Rights: All copyrights, ownership, and intellectual property rights to the uploaded audio files remain 100% with the User. The Service Provider acquires no licenses, distribution rights, or reproduction rights to the works.
• Ephemeral Storage: During the analysis process, audio files are stored temporarily in the server's cache (RAM/Temp) only for the duration of the processing. Once the analysis is complete, the audio file is immediately, automatically, and permanently deleted.
• AI Training Exclusion: The Service Provider explicitly guarantees that uploaded audio files are NOT used for training, fine-tuning, or developing Artificial Intelligence models or machine learning databases.
• No Human Access: The process is fully automated and closed. No human staff members listen to the uploaded audio, and no third party can access the content.

4. DATA PROTECTION AND GDPR COMPLIANCE

In accordance with Regulation (EU) 2016/679 (GDPR), the Service Provider handles personal data as follows:

• Data Collection: We only collect data necessary for registration and billing (Name, E-mail address, Billing address).
• Payment Security: Payments are processed by independent, certified third-party providers (e.g., Stripe, PayPal). The Service Provider does not store or have access to credit card information.
• User Rights: Users may request the correction, restriction, or permanent deletion of their account and associated personal data at any time via the account settings or customer support.

5. USER OBLIGATIONS AND ABUSE PREVENTION

• Copyright Warranty: The User warrants that they own all rights to the uploaded files or have obtained all necessary permissions for analysis.
• System Integrity: Users are prohibited from reverse-engineering the platform, utilizing automated scripts (bots) to overload the service, or uploading non-audio file formats.
• Consequences of Abuse: Any violation of these terms may result in the immediate suspension of the user account and forfeiture of remaining tokens.

6. LIMITATION OF LIABILITY (DISCLAIMER)

• Market Guarantee: The AI analysis is a statistical prediction based on data patterns. The Service Provider does not guarantee actual commercial success, revenue, or chart performance for any analyzed work.
• Technical Availability: While we strive for 99.9% uptime, we are not liable for disruptions caused by global internet failures or third-party infrastructure outages.
• Token Re-crediting: If an analysis fails due to a verified technical error on our part but tokens were deducted, the Service Provider shall credit the tokens back to the User's account within 48 hours of notification.

7. COOKIE POLICY

Our website uses essential cookies necessary for technical operation (e.g., login sessions). Third-party marketing or tracking cookies are only applied with the User's explicit prior consent.
